DKP - Policies





A minimum of 50% deposit as well as full acceptance of the terms and conditions secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. (Reason: the date you booked was held, and other clients were turned away resulting in loss of business for the photographer). Payment in full of the remaining balance will be due no later than one calendar week before the wedding day. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

Check Payments - As good business practices, and in agreement with our financial institutions we follow guidelines on accepting any payments by checks, in an effort to mitigate fraud and scams. See below!


  • Identity of individual sending/authorizing check must be confirmed & up to date. (passport, drivers license etc) 

  • Address of Individual must be confirmed 

  • Checks must verified by our financial institution, and cleared prior to issuing of receipts and contracts.

  • U.S Checks are to be deposited directly to our U.S bank account (in some cases we can arrange for courier to pick up)

  • Clients wanting to send checks can FEDEX only! After the above criterias have been satisfied. 



The details of the wedding arrangements are to be agreed beforehand in writing (by email). The Client shall notify the Photographer of any changes to these details (by email). The Photographer/s cannot be held liable for delays or disruption in their delivery of the service until any changes are received, and acknowledged in writing.



The Client may cancel this contract at any time by giving written notice by email to The Photographer/s but in doing so shall forfeit any monies paid. For wedding deposits however, the photographer will allot up to 50% of deposit toward shoot credit for Digital Photographer service (portrait or lifestyle session images only). Note: All cancellations MUST be in writing.



Due to the nature of digital photography and the fact that photographers, once booked cannot use date chosen by clients for any other purpose. Digital Kafe Photography has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the client selected and paid for a wedding option) it is then considered non-refundable.  Refunds will NOT be given due to “not liking a photo” etc.,  after the client has already received the images, or any other reason. If a mistaken image is sent to the client, or such image can be corrected through editing Digital Kafe Photography with correct image free of charge.


While we try our best to work with all our clients, and understand that life happens, we are still a business and must be able to cover our cost. While we will still provide you with your photography/videography services, late balance payment will result in any free services being forfeited, this includes, books and prints, photo booth, free sessions etc.  This will also delay the editing and completion of your images/video. 



The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.



All images receive a basic DK style editing adjusted for exposure, brightness, contrast, sharpness, lighting, color. The Photographer's judgment regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching is very different this includes digital manipulation - removing blemishes, brightening teeth, smoothing skin, removing distractions in the background and adding “simple” effects etc., this is not included in all images you receive but reserve for select image for large print, books etc. Bulk images like wedding images will be edited only.



All additional prints and reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.



In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.



In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. 


Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.



The parties agree to a pre-event consultation (by phone, email, or in person) at least one to two weeks before the event date in order to finalize the actual shooting times, locations, Client request list and portrait sessions for photographs that cannot be obtained during the wedding. Portrait sessions take at least an hour and extra charges for said sessions may apply. If the bride's or groom's late arrival prevents a full guaranteed time from occurring at said sessions, the photographer shall not be held liable for failure to take desired photographs.



The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Client in a manner enjoyed by all parties. Client and the Photographer agree that cooperation, communication and punctuality are therefore essential to that purpose. If Client or other individuals to be included in event or the planned portrait sessions are late or absent, the Photographer shall not be held liable for not photographing said individuals.



Due to the unpredictable and uncontrollable nature of weddings the Photographer can make NO guarantees regarding the delivery of any specific photograph, although the Photographer will make every reasonable effort to meet the desires of the Client. To that end, if specific shots are requested, the Client must provide the Photographer with a written list of people, groupings, or shots that they feel are most important to them. It is the sole responsibility of the Client to point out VIP guests to the Photographer and request pictures of them on the day of the wedding. The Photographer shall not be held liable or responsible for any persons present at the wedding or reception that were not photographed.


Our services are offered to complement our wedding services and client events. At all times our goal is to offer the customer services to our clients, while protecting our investment. We are not responsible for inclement weather, nor will we tolerate unruly, belligerent or disrespectful guest at a client event. This includes drunk and disorderly patrons. At anytime during your event if our team/staff feel threatened/uncomfortable or our equipment is at risk of damage, services will be immediately terminated.



The Photographer reserves the right to charge the Client travel fees estimated by representatives of the Photographer. Travel fees will be applied when deemed applicable, based on, but not limited to charges incurred while traveling to the ceremony and/or reception location (such as hotel, airfare, rental car).


FORCE MAJEURE (Acts of God/Nature)
In the event naturally or unnaturally occurring “Acts of God” conditions, due to the same, the Photographer can in no way be held responsible for services that cannot be carried out as a result. This includes rain, storms, hails, snow, earthquakes, floods, mudslide and other such acts.



The photographer is limited by the guidelines of the venue and event officials and/or management. Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the Client's responsibility; the Photographer will offer technical recommendations only.


Under the Terms Copyright Act, in the Commonwealth of the Bahamas copyright in all photographs taken by Digital Kafe Photography remains the sole property of Digital Kafe Photography. By accepting these Terms and Conditions the Client hereby gives permission to Digital Kafe Photography to use all images and reproductions on the Business web sites and for displays, samples, self-promotional advertising and photographic competitions. The Client may print photographs taken under this contract. Client is not allowed to alter, change, disfigure crop, or ruin in any way photographs taken by this contract. Any of such is to request by client to Digital Kafe Photography. All rights including copyright and reproduction rights relating to work, images (whether electronic or otherwise), ownership of goods and services which are photographed, taken, produced or supplied by Digital Kafe Photography.



● The Client must obtain written permission from the Photographer prior to the Client or their friends and relatives publishing the photographs.
● Digital files may be used by the Client for personal, non-commercial use and for the purposes of the reproduction and giving of photographs to friends or relatives.

● The Client may NOT edit photographs in any way, including by not limited to changes in color, contrast or cropping. If further editing of the images beyond what the Photographer has delivered is desired by the Client, it is the Client’s responsibility to contact the Photographer and request any re-edits. Charges for re-edits may be applied at the Photographer discretion.

● Photographs taken by the Photographer may not be sold or reproduced with the intention of profit by the Client.



The Photographer, their assistants and/or designates, shall be the only entities providing commissioned photographic services on the wedding date specified. In the circumstance of any additional photographic services by another person or company not apart of the Digital Kafe Photography team, this most be known to the photographer, also that Digital Kafe is the primary event photographers for that day. Note: Because of the unique style and editing techniques only images captured by the Digital Kafe team will be included in galleries, any related wedding products. 



The Photographer reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the EVENT(S); or in the event that the safety of the photographer is in question.



All your guests will have digital cameras and all your guests will want to photograph the bride and groom. In the spirit of cheerful cooperation the bride and groom agree to give the Photographers precedence over your guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the bride and groom have continually interrupted the photographer’s work.
